About The Business

JJS Property Services is based in Exminster (Near Exeter, Devon). The company is owned by James Towill who operates as a Sole Trader.

1 – Terms & Conditions of Business
By accepting estimated costs, you accept the terms and conditions of business of JJS Property Services.

We recommend that you read these terms and conditions and print a copy for your future reference.

Occasionally we may amend these terms. Please check these terms to ensure you understand the terms that apply at that time.

Nobody has the authority to alter or vary these Terms in any way without the written agreement of James Towill – the owner of JJS Property Services.


These terms and conditions shall be interpreted in accordance with UK Law.


2 – Estimates
Estimates provided are not detailed and contain a total estimated price for the job along with a brief description of work. Whilst we appreciate that some customers may prefer a detailed (broken down) estimate, as a small business we simply don’t have the time or resources to offer this level of service.

Estimates can be provided via e-mail, text message, WhatsApp, Facebook Messenger or in writing on request.

Every estimate is subject to withdrawal, correction or alteration at any time prior to the acceptance of the order.

All estimates are accepted on the basis that full payment be made on satisfactory completion of the work (the day of completion). All estimates are based on installation during normal office working hours – Monday to Friday (9am to 4pm).

Estimates a valid for 30 days from the date of issue.

In the event that any additional unforeseen related work is required during the works all costs will be added to the final invoice up to the value of £350. Beyond this we will stop works to discuss the situation and re-commence work once a practical solution
and any other costs have been agreed.

If you request any additional works whilst we are on site we will provide you with a separate estimate. Once accepted, we will try (where practical) to complete these additional works prior to leaving site. Where this is not operationally possible additional work will need to be booked for a later date.


3 – Orders
All orders placed by you are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances.

To submit an order you are required to accept the estimated costs by reply of e-mail, text message, WhatsApp, Facebook Messenger or in writing for customers who have requested a paper option.

A 50% upfront payment is required on all estimates of over the value of £400. After submitting an order and any upfront funds have cleared we will strive to contact you within 2 working days to confirm your order has been accepted and agree a start
date.

All orders placed are subject to the cancellation period.
In circumstances where we are unable to fulfil the order as placed, we will consider the contract at an end and refund your 50% upfront payment at which time our obligation to you will end.
We may cancel your order at any time prior to work commencing without reason. A full refund will be given.

4 – Sub Contractors
In periods of high demand or during larger projects where a variety of multi-skilled people are required we may employ sub-contractors to support the delivery of orders. In these circumstance we will project manage and supervise works to ensure our normal high standards are maintained.

5 – Pricing & Payments
Estimates
Estimates are FREE. We always suggest and prefer to meet customers face to face before starting any work. This gives us an opportunity to chat through the required work, make a plan and agree an estimated price in advance. Experience tells us that
the majority of our customers prefer ‘a priced work’ approach as it helps them to budget and provides peace of mind.

Minimum Visit Charge (Odd Jobs)
Minimum visit charge is £80 and covers the first hour of labour. Additional labour is then charged at £80 per hour charged in 30min/£40 slots.

Gutter Cleaning (Hoovering & Wash)
Option#1 – Hoover Only (£150).
Option#2 – Hoover & Wash (£300).
Price based on typical 3 bedroom semi-detached house with up to 15 metres of guttering.

Note: Conservatory cleaning/washing is available on request as part of this service and typically costs an additional £75.

Gutter Repairs
We offer a gutter hoover and repair service where a fix can be safely achieved from a ladder. In line with our own ladder SAFETY rules this is a 2 person job. The price of £200 includes any new fixtures, fittings and or sealants required and is guaranteed
for 12 months. Additional repairs are charged at £70 each.
We also offer a next working day emergency repair service for £300.

Scaffolding Tower Hire
In some scenarios (following our own personal health and safety risk assessment) we may decide that a scaffold tower is required for us to achieve a SAFE repair. In these circumstances the cost to repair (including scaffold tower hire) is £450.

Fencing, Decking & Sheds
These job types are more complex in nature and are longer in duration. Estimates are provided on request and include the supply and fitting of all materials and fixings and licenced waste removal.


All materials remain the property of JJS Property Services and must not be altered until paid in full. For example, no woods painted.

Solar Sales

Payment Methods
All work must be paid for on the day of completion unless otherwise agreed in writing.


Types of payments accepted – cash, cheque or bank transfer.


Non-Payments
Failure to pay on the day of completion may result in our Solicitor being actioned to recover our costs and any/all associated legal costs.


6 – Timescales
Once an order has been accepted, we aim to contact you within 2 working days to arrange a start date.

JJS Property Services will strive to ensure that we meet any agreed start date. However, delays can happen due to a variety of factors. If this happens we will notify you of the intended new start date  and will not be held liable for any losses incurred.

7 – Deliveries
Although we can give you an expected delivery date as given to us by our supplier we cannot guarantee these dates, and will not be held liable for any losses incurred because of late delivery.
You are responsible for the safe keeping of all materials delivered to site.

8 – Installations
You are responsible for ensuring that any work you order can legally be carried out at your property – fencing, sheds, pergolas and any other structures.


Installation dates are given in good faith but are estimates only and can be influenced by many factors.


When having a fence installed;
It’s your responsibility to supervise the installation team and advise them of the location (boundary) of the new fence.

We are not liable for any disputes regarding location of the new fence once installed.

Unless stated in the estimate no allowance has been made for any obstructions such as rock, concrete, tree roots, broken posts or any other matter which may be encountered during the performance of the works. You will be charged for any
additional labour plus the hire costs of any necessary equipment required to remove such unforeseen obstructions.

As per section 2 above – in the event that any additional unforeseen related work is required during the works all costs will be added to the final invoice up to the value of £350. Beyond this we will stop works to discuss the situation and re-commence work
once a practical solution and any other costs have been agreed.

We do our best not to damage any garden plants when undertaking fencing installations (or any other work) but we must be able to cut back any material as necessary so that we can safely access work areas. Please ensure that we are made aware of any materials, items, trees or shrubs etc. that may need protecting.


We will do our best not to damage any items. However, we accept no responsibility for the accidental damage of these items.

We retain the right to cancel or re-arrange a job at short notice.

9 – Underground Services
The landowner or customer must inform us of any underground services that may pose a problem to agreed work.
We shall not be liable in any event of damage affected by any installation to electrical cables, gas or water mains, sewerage, telephone lines, and any other service facility or utility.

10 – Electrical Work
Non-notifiable: In line with current Building Regulations JJS Property Services can carry out minor (non-notifiable) work without notifying the local building control office or involving a qualified electrician.

Notifiable:  All notifiable electrical work will be carried out by a qualified third party. This cost will be incorporated within your original estimate. However, should the electrician find residual faults in your home preventing the issue of a safety certificate
you will be expected to pay these separate costs. Examples of notifiable work are adding any new circuit (ring), house re-wires, change of consumer unit and work in a special location.

11 – Appointments Reminder, Missed Appointments & Aborted Visit Charges

Reminders – a text message will be sent or a telephone call made the day before we visit as an appointment reminder.

If a customer is not at home within 1 hour of the agreed start time we will leave site and charge the a £95 missed appointment charge.

On some occasions customers may request to supply materials. If these materials are not available on the day as agreed and work cannot continue as planned they maybe charged a £95 aborted visit charge.

In either scenario the customer will be required to re-book works.

12 – The Law
These terms and conditions shall be interpreted in accordance with UK Law.

It is your responsibility to ensure that any work you order can legally be carried out at your property.

You and JJS Property Services agree that English law applies to these Trading Terms and that any dispute between us arising out of or in connection with these Trading Terms will only be dealt with by the English courts.

JJS Property Services will in no circumstances accept liability for any consequential loss, or loss of profits or third party claims or detention or delay or expenses of any kind howsoever caused.

13 – General
Illustrations – all illustrations are intended for demonstration purposes only and may not look like the final product.


Gutter Cleaning
Chemicals – we do not use commercial strength chemicals when cleaning gutters as splashing (especially when windy) can occur, sometimes even on nearby properties. We simply use washing up liquid which is applied directly on the cleaning brush. This helps us keep property, people and pets safe.

Waste – gutter waste is typically made up of leaves and moss and can be either added to the customers compost heap or put on a green bin.

JJS Property Services will exercise reasonable care in performing gutter cleaning services, but will not be liable for any damage to the property arising from pre-existing conditions which can be exposed during the washing process. This includes lose or broken brackets, connectors, end caps or soffit vents or any other unforeseen circumstances.

Where plastic guttering, soffits and facias have become stained or where soffits and facias are made of wood its important to note that there is only a certain level of cleanness that can be achieved.
The client is responsible for notifying JJS Property Services of any known issues
with the gutters or roof that may affect the performance of the services.

Other cleaning services maybe available on the day such as windows, conservatory, decking and patios. Prices will be provided in real time on request.

Gutter repairs are not included within a standard cleaning service.

Gutter Repairs – any defects identified in real time will be highlighted and where possible a solution and price to fix will be provided. Typically the price to deploy a ladder for basic repairs such as re-fixing an end caps, joiner sections or air vents is
£75 each. Where new parts are required and another visit is required a separate estimate will be provided.
All promotional offers are subject to operational availability and maybe changed or cancelled at anytime without reason.

14 – Guarantee
JJS Property Services guarantee to repair or replace free of charge, any materials which develop a fault due to faulty construction, for a period of 12 months from the date of the installation.
Timber is a natural organic material and will contain knots and sap; the timber may swell, shrink and or warp which can cause splitting to occur. This is to be expected (especially when repairing a shed) and we cannot be held liable or responsible to exchange goods or to refund monies in this event.

Where customers are considering custom build timber sheds and or summer houses JJS Property Services recommends that these structures are built on a concrete base to reduce the chance of water ingress and prolong the overall life of timber.

Where customers choose alternative cheaper solutions JJS Property Services cannot guarantee complete dryness within the building as damp can be transferred via timber where surrounding drainage is poor or a naturally high-water table exists.

Re-roofing sheds and other outbuildings is a common job. Typically in these situations the roof will be assessed with the customer present so they can also see the roof and make there own informed decision. Options are to replace the whole roof (support timbers, plywood, roofing felt and trims) or just replace the felt and
trims.

JJS Property Services advise all customers to fully re-roof any sheds or outbuildings for complete peace of mind. This is because when outbuildings are assessed in warmer and dryer conditions there may not be any obvious signs of deformed roof timbers. However, timbers can change shape in different atmospheric conditions which can cause sagging. This may lead to water pooling and ingress on newly fitted felt.

JJS Property Services will not be responsible for any future leaking due to any form of sagging where a basic roof re-felt was chosen.
JJS Property Services guarantee is additional to your statutory rights, but you must notify us in writing within the guarantee period if you wish to make a claim under the terms of the guarantee.

Workmanship is guaranteed for 12 months in line with our affiliation to Checkatrade.

15 – Cancellation
Once your order has been accepted, confirmed and scheduled you will have a period of 14 days to cancel and receive a full refund of your upfront payment – these are your consumer rights within the UK.


If you wish to cancel the contract within 14 days you must do so in writing by e-mailing info@jjsps.co.uk.

If you require and agree for work to begin within the 14 day cancellation period and then a £95 cancellation fee will apply if you cancel your appointment.

Jobs maybe cancelled on the day due to adverse weather conditions like high winds, snow or ice (matters beyond our reasonable control). In these circumstances a full refund will be given and the customer will need to make a new appointment date.

We may cancel your order at any time prior to work commencing without reason. A full refund will be given.

16 – Privacy Policy & Data Protection
JJS Property Services does not disclose any customer details to third parties. We are committed to protecting your privacy. We will never collect, nor attempt to collect sensitive information about you without your consent.

The only data collected is the key information required to complete the order which includes your name, address, e-mail, contact and payment details. We will always ask if we can take photos at
your property and use them on our social media platforms for promotional purposes.

18 – Complaints & Standards
We hope that you will never feel the need to complain. However, should you wish to make a complaint, please contact the owner James Towill writing by e-mail at info@jjsps.co.uk. James will aim to acknowledge receipt of your complaint within a period of 14 days of its receipt and to respond fully within 28 days of this.
